The Drugs and Cosmetics Act of 1940 governs the registration of cosmetics in India, defining a cosmetic as “an article intended to be, poured, sprinkled, or sprayed on or otherwise applied to any human body or any part thereof for the purpose of washing, promoting beauty, or altering appearance, and also includes an article intended to be used as such.”

To produce any item from the above-mentioned list, a licence issued from a licencing authority established by the State Government is necessary. The application must be completed in Form 31, together with a licencing cost of Rs. 2500 and an inspection charge of Rs 1000. Furthermore, the producer must ensure that the manufacturing is carried out in the presence of qualified and competent technical personnel, with at least one of the personnel meeting the educational qualifications listed below.

Documents Requirement for Obtaining Cosmetic Manufacturing Licence in Rajasthan

  • Application Form
  • Fees challan receipt, if not paid through the web portal.
  • Proprietor/Partners/Director(s)/Managing Director Affidavit/Declaration. Moreover,
  • A list of all the Partners/Directors, including their ages and their postal and residential addresses.
  • Authorized Signatory’s specific power of attorney to file Application on behalf of the Company on Rs 10/- Non-judicial Stamp paper duly confirmed by Notary Public.
  • Manufacturing Chemist’s Affidavit/Declaration
  • Analytical Chemist’s Affidavit / Declaration. In addition with, Educational qualification, experience, and approval certificates of proposed Manufacturing and Analytical Chemists; Appointment Letters; Id Proof; Pharmacy Council Registration Certificate (if applicable).
  • A signed Site Master File. Moreover, Product sheets are in a predetermined format for product approval.
  • A section-by-section list of plants and machines, analytical equipment, and apparatus for physicochemical, microbiological, and biological testing, as well as attested photocopies of purchase invoices
  • A list of the necessary safety equipment. In addition to AHU (Air Handling Unit) specifications, including qualification information and a schematic diagram.
  • Water System Specifications, including Qualifications and Schematic Diagram Reports on water testing.

  • Where applicable, a description of the manufacturing process with flow diagrams and in-house requirements. Moreover, the Approach of product analysis.
  •  Further, the applicant should present the relevant copies of the BIS.
  •  Medical check-up -The certificate of technical personnel and employees should include the absence of contagious disease.
  • District Industries Center Registration. Moreover, Rajasthan State Pollution Control Board approval for establishment and operation.
  • Provided is a list of reference books and literature.
  • Documentation pertaining to ownership for the planned unit’s location, as well as documents supporting it.
  • Memorandum and in addition to Articles of Association / Partnership Deed.
  • Specific resolution for the start of Cosmetics manufacturing (if not already included in Memorandum of Association).
  • Further, Section-by-section layout/blueprint of plant and machinery locations (in metric system), as well as a site plan. Moreover, If working with explosive or flammable material, obtain a NOC from the Fire Safety Officer and/or the Controller of Explosives (where applicable).

Procedure for obtaining Cosmetic Manufacturing Licence in Rajasthan

Step 1: Filing of Application: The applicant must apply online using Form no. 31, and pay the required fees as listed in the fee chart under ‘Forms & Fees’ on Rajasthan’s online portal.

Step 2: Examination of the application : The Examining officer will scrutinize your application and may ask question if he discovers any weakness or discrepancy.

Upon receiving clarification from the applicant, further action will be taken. If the application is confirmed to be in good standing, it will be processed for factory inspection. The CDSCO will be notified of the application and will be asked to send an inspector to conduct a joint examination of the premises.

Step 3: Inspection of the potential location: Inspection of the potential location will take place by the officers from the board and will check the quality of product produce with in the manufacturing plant.

Step 4: Result of Inspection: If any deficiencies or discrepancies are discovered during the inspection, the applicant will be notified and given the opportunity to correct them before submitting a compliance report.

Step 5: Compliance Report: The compliance report will be provided to the concerned officer for verification once it has been received from the applicant.

Authority will forward the application to the next step if there is no mistake in the application.

Step 6: Scrutiny of Products: The details of the products requested will be examined, and if they are deemed to meet the requirements, the application will be considered for a licence.

Step 7: Grant of License: After discovering that all the documents and procedures are fulfilled as per rules and norms, the state Authority may grant the license to the applicant.
